Thanks for choosing Hamilton Roder. These terms set out how we work together – what you can expect from us, and what we need from you. Please read them before placing an order.
01About these terms
These terms apply to your use of the Hamilton Roder website and to any services you order from us, including websites, hosting, domains, advertising campaigns, SEO, SEM, social media, email, SMS, influencer and AI search (GEO) services. By using our website or placing an order, you agree to these terms.
If you have a separate signed agreement or proposal with us, that document applies alongside these terms, and takes priority if the two are inconsistent.
02Quotes and orders
- Prices and package descriptions on our website are a summary. The details of what's included are confirmed in your order confirmation, quote or proposal.
- Where a service shows “Quote” or “TBC”, submitting a request is not a purchase – we'll send you a quote to accept before any work starts or payment is taken.
- We may decline an order, for example if the service isn't suitable for your business or the request is outside what we offer. If we decline after you've paid, we'll refund you in full.
03Pricing and payment
- Unless stated otherwise, prices are in Australian dollars (AUD). Where GST applies, it will be shown on your tax invoice.
- One-off services (such as website packages) are payable as set out in your order or quote.
- Monthly services (such as hosting) are billed in advance each month until cancelled.
- Campaign services are charged per campaign. Your quote or package description will state whether advertising spend paid to platforms such as Meta, Google or LinkedIn is included.
- Card payments are processed securely by our payment provider. We may pause work on services with overdue accounts.
04Your responsibilities
To help us deliver on time and to a high standard, you agree to:
- give us accurate information, timely feedback and approvals;
- provide the content, logins and platform access we reasonably need;
- make sure any material you give us (text, images, logos, data) doesn't infringe anyone else's rights and that you have permission to use it; and
- comply with the policies of any platform we use on your behalf, and with laws such as the Spam Act 2003 for email and SMS marketing.
Delays in providing what we need may affect timelines.
05Intellectual property
Once you have paid in full, you own the final deliverables we create specifically for you, such as your website design and content, campaign creative and reports. We keep ownership of our pre-existing tools, templates, code libraries and know-how, and grant you a licence to use them as part of your deliverables.
We may show non-confidential work we've created for you in our portfolio and marketing, unless you ask us not to.
06Results and third-party platforms
We use our expertise to achieve the best possible outcomes, but we can't guarantee specific results such as search rankings, AI search mentions, reach, leads or sales. These depend on many factors outside our control, including platform algorithms, competition and market conditions.
Platforms such as Google, Meta, Instagram, LinkedIn and domain registries set their own rules and may change, suspend or reject ads or accounts. We're not responsible for their decisions, outages or policy changes.
07Cancellations and refunds
- Monthly services can be cancelled at any time by contacting us. Cancellation takes effect at the end of the current billing period.
- Projects and campaigns can be cancelled by giving us written notice. You'll pay for work completed and any costs we've committed to (such as advertising spend, domain registrations or third-party licences) up to the date of cancellation.
- Domain registrations are generally non-refundable once processed by the registry.
Nothing in these terms limits your rights under the Australian Consumer Law. Our services come with guarantees that cannot be excluded, and if there is a major failure you are entitled to a remedy.
08Limitation of liability
To the extent permitted by law, we're not liable for any indirect or consequential loss, including loss of profits, revenue, data or opportunity. Where our liability for a failure to comply with a consumer guarantee can be limited, it is limited to supplying the services again or paying the cost of having them supplied again.
09Using our website
The content on this website is general information only and may change without notice. Free resources are provided “as is” for your own use. You must not copy or republish our website content for commercial purposes without our permission, or use the site in a way that could damage it or disrupt other users.
Our website may link to third-party sites. We're not responsible for their content or practices.
10Privacy
We handle your personal information in line with our Privacy Policy.
11Governing law and changes
These terms are governed by the laws of New South Wales, Australia, and you agree to the non-exclusive jurisdiction of its courts. We may update these terms from time to time; the version on this page at the time you place an order applies to that order.
